Microsoft-owned LinkedIn has agreed to pay $6.625 million to resolve claims by advertisers that it overcharged them by presenting inflated user engagement metrics for video advertisements. As part of the settlement, LinkedIn is required to hire a reputable independent auditor to review its advertisement metrics, as detailed in the plaintiffs’ request for preliminary approval in the U.S. District Court for the Northern District of California.

The employment-focused social media platform has updated its agreements with advertisers according to the legal document.

The compensation will be distributed to advertisers who used LinkedIn’s advertising services from January 2015 through May 2023, which has roughly 300,000 members, as outlined in the settlement motion. The settlement still requires the approval of U.S. Magistrate Judge Susan van Keulen in San Jose.

While agreeing to the settlement, LinkedIn, based in Sunnyvale, California, has not admitted any wrongdoing and continues to deny any improper actions.

Why LinkedIn is facing a lawsuit over its ad policy

The lawsuit originated from allegations in November 2020 by companies including TopDevz of Sacramento and Noirefy of Chicago, claiming that LinkedIn exaggerated the number of video ad viewers to overcharge advertisers.

The allegations also claimed that LinkedIn inflated its metrics by counting views from videos that played in users’ LinkedIn apps but were off-screen due to users scrolling past them.

This legal action began shortly after LinkedIn acknowledged in November 2020 that its engineers had rectified software errors that might have led to over 418,000 instances of overcharging, most for amounts less than $25.

LinkedIn has suggested that it compensated nearly all affected advertisers.

In December 2021, Judge van Keulen dismissed the lawsuit with prejudice, stating the plaintiffs had not proven their legal remedies were insufficient before resorting to suing under two California statutes that only offer equitable remedies such as restitution.

At that time, she noted that LinkedIn was not implicitly required to provide “accurate ad metrics,” referencing its disclaimer that absolves it of responsibility for click fraud or unauthorized third-party activities that could inflate ad costs.

The advertisers appealed this decision, but the appeal was then paused as the parties entered settlement talks.

Amidst these legal proceedings, Microsoft reported a 17 per cent revenue increase for the quarter ending March 31, with overall revenue reaching $61.9 billion. LinkedIn itself reported a 10 per cent revenue boost during this period. The tech giant is set to release its most recent quarterly results on Tuesday (July 30).

On July 19 the American cybersecurity company CrowdStrike put out a faulty update that shut down IT infrastructure and caused widespread outages across the world, mainly seen through the cancellation of flights but also felt in other industries.

It’s believed to be the largest technology outage in IT history; Microsoft has reported that around 8.5 million Microsoft Windows devices were impacted. Hospitals and other businesses were unable to carry out normal functions as the infamous “blue screen of death,” usually just an annoyance for personal computing users, brought an alarming number of critical services to a full stop.

Since the update failure, both Microsoft and Crowdstrike have been working to understand the issue and help those who have been affected. Microsoft published a technical analysis of the outage on Saturday (July 27), the same day that CrowdStrike published its Preliminary Post Incident Review on Saturday (27 July).

Microsoft confirms CrowdStrike outage reason following analysis

In CrowdStrike’s analysis, they say the issue came down to a memory safety issue which was a read out-of-bounds access violation in the CSagent driver. This is a module designed to detect activity that looks suspicious.

Microsoft has corroborated this and explains how its Kernel Debugger and other free-to-use extensions were used to find the memory safety issue to be the root cause.

The technology giant’s analysis included the team restoring the stack frame at the time of the access violation to learn more about its origin. However, due to only being able to see a compressed version, they were unable to disassemble backwards to see the larger set of instructions before the crash.

After explaining how they confirmed CrowdStrike’s analysis to be correct, they explained how the cybersecurity company loads four driver manuals in its kernel driver architecture.

They say this is commonplace due to the system-wide visibility it can present, along with potential performance benefits and the tamper resistance factor.

CrowdStrike has taken full responsibility for the outage and its chief executive has apologized for its malfunctioning software update.

The ongoing battle between the United States and TikTok continues as the Department of Justice has alleged that the video-based company has shipped personal information to China.

This information is said by the Department to have allowed profiling of the app’s users to take place.

This all comes from a new filing that has emerged while the duo are engaged in a major disagreement that would see the app’s parent company ByteDance having to force a sale of the platform’s US-based operations. If this doesn’t happen, a full closure is required.

This document was filed on Friday, 26 July and on 16 September, the US Court of Appeals for the District of Columbia will hold oral arguments. It’s then that the future of TikTok will be decided, following months of back-and-forth between the two.

The last few months have all come about as US lawmakers are concerned the 170 million Americans who use the app could be having their data accessed by China.

US says data has been shared through an internal communications tool

The filing points to an internal tool called Lark, also known as ‘Feishu,’ which is apparently what TikTok staff use for internal communication. The filing says this hosts TikTok’s internal platforms and allows employees to interface directly with engineers in China.

It’s through Lark that the DoJ alleges “significant amounts of restricted US user data (including but not limited to personally identifiable information)” was shared.

They say this has resulted in “certain sensitive U.S. person data being contained in Lark channels and, therefore, stored on Chinese servers and accessible to ByteDance employees located in China.”

The filing further claims that an internal project was created in 2022 that “aimed at identifying and removing certain sensitive U.S. user data improperly maintained on Lark channels.

“At least as of 2022, Lark contained multiple internal search tools that had been developed and run by China-based ByteDance engineers for scraping TikTok user data, including U.S. user data.”

They say this allowed “China to collect bulk user information based on the user’s content or expressions, including views on gun control, abortion, and religion.”

OpenAI has introduced SearchGPT, a search feature aimed at providing “timely answers” using information from the web.

The interface of the engine is similar to that of ChatGPT. Users enter a query, and SearchGPT presents web-based information and images, including links to sources, as well as links for further exploration and follow-up questions through a sidebar.

Location-based searches are possible with SearchGPT. According to an OpenAI support document, it “collects and shares” general location data with third-party search providers to improve results, like displaying nearby restaurants or the weather forecast. In addition, users can opt to provide more precise location details through a settings menu toggle.

SearchGPT is powered by OpenAI models, specifically GPT-3.5, GPT-4, and GPT-4o. Described as a prototype by OpenAI, SearchGPT is currently only available to a limited group of users and publishers, with a waitlist available. The tech giant plans to incorporate some of SearchGPT’s features into ChatGPT in the future.

In a blog post, it stated that finding answers online “can take a lot of effort” and believes that “enhancing the conversational capabilities of our models with real-time information from the web” can simplify and speed up the search process.

OpenAI attempts to distance itself from AI engines with SearchGPT

Despite excitement, the timing of SearchGPT’s launch is notable as AI-powered search tools face scrutiny over issues like plagiarism and inaccuracies. Hence, OpenAI says it is taking steps to ensure responsible use, similar to Perplexity’s approach.

OpenAI stressed that SearchGPT “prominently cites and links” to sources, with “clear, in-line, named attribution.” The company is also collaborating with publishers to tailor the search experience and allowing website owners to manage how their content is displayed in search results.

The company has also clarified that SearchGPT’s function as a search tool is separate from the training of its generative AI models, stating that websites can appear in search results even if they opt out of AI training.

How to join the waitlist

To access SearchGPT, you must have a ChatGPT account. After logging in, visit the website to sign up for the waitlist. Select the black “Join waitlist” button. It will turn gray and display a checkmark with the message, “You’re on the waitlist.”

First tests will involve up to 10,000 participants. However, OpenAI has not specified the duration of the testing phase or detailed plans for broader integration into the ChatGPT service.

Apple’s new AI features will miss the initial launch of the iPhone and iPad software overhauls and will arrive later than planned.

On Sunday (July 28), Bloomberg reported that the iPhone maker is planning to roll out Apple Intelligence to customers as part of software updates coming in October, a month later than expected.

They said people familiar with the matter say the AI features will arrive a few weeks after the iOS 18 and iPadOS 18 releases which have been planned for September.

The aim is for Apple Intelligence to be available for software developers for the first time for early testing as soon as this week. This will be through iOS 18.1 and iPadOS 18.1 betas.

It’s also believed that some of the more advanced Siri features will be absent from the delayed release, as a full rollout is now stretching into 2025.

This setback could be a minor blow for the company as they have been teasing its new features for some time now. It was at the Worldwide Developers Conference where the news was formally announced following months of circulating rumors.

The company hasn’t yet commented or responded to the claims reported by Bloomberg.

Apple AI: What is the upcoming Apple Intelligence?

Described as being a ‘personal intelligence system,’ the AI tool will be featured across Apple’s multiple platforms.

It includes new writing-related tools and allows for group threads to be shortened and summarized, along with help finding the right words when drafting messages and emails through the ‘smart reply’ feature.

Priority notifications will be implemented too, so you can choose what matters the most to you and have these appear at the top. These are then summarized, with the most important elements of a message being pulled out.

They have an image-like generator tool too, titled Genmoji. With this, people can sketch anything they like and have this turned into a related image.

Siri will have a makeover as well, with an all-new design as it becomes more integrated into the full experience. Product knowledge is set to improve, along with a greater understanding so the AI chatbot can reply with more accuracy.

With less than two weeks to go before Lionsgate shares its Borderlands film with the world, fans are still not convinced.

The final trailer for the Borderlands film was released last Wednesday (July 24) and all hopes and dreams of it being a stellar game to film adaptation appear to have been crushed for many.

The responses to the last insight (before it hits the big screen) into the Eli Roth-directed film are pretty scathing, with user Grant Gabel having said: “What if you just didn’t release this and we all agreed to never talk about this again?”

Another commenter, called Dread Jaws, wrote: “Man, how does it look worse with every ad?”

A user called Stri06 described it as being an “insult to the Borderlands fans. No Borderlands movie is much better than having this abomination…”

People have then gone on to pick apart the editing, casting choices, and script, with fans predicting the movie to be a major flop. If so, this would be a huge contrast to the success of the action role-playing video game franchise which first began in 2009.

Borderlands’ most well-known characters are played by some huge stars like Kevin Hart, Jamie Lee Curtis, and Cate Blanchett. But even that might not be enough to appease the audience.

The Borderlands rating continues to confuse fans of the game

It’s not just the trailers that have left a sour taste in mouths, but the film age rating too.

The franchise is known for its signature crude humor and gory violence, with all the mainline games in the series having an M rating. This means they’re suitable for mature audiences of 17 or over.

However, the upcoming film debut has received a PG-13 rating from the Movie Picture Association which has left fans even more concerned as it seems a far cry from the Borderlands they’re used to.

With artificial intelligence advancing, experts have long warned about the consequences of the technology when used incorrectly. Now, more concerns have been raised after a manipulated AI video mimicking the voice of Vice President Kamala Harris has been shared.

The video is laden with ‘Harris for President’ branding and even includes some real clips from the past. A voice-over audio has been added which impersonates the Vice President and claims she’s a ‘diversity hire’ and doesn’t know ‘the first thing about running the county.’

The voice in the video says: “I, Kamala Harris, am your Democrat candidate for president because Joe Biden finally exposed his senility at the debate. Thanks, Joe.”

“I was selected because I’m the ultimate diversity hire, I’m both a woman and a person of color. So if you criticize anything I say you’re both sexist and racist.”

The almost two minute long video was created by a YouTuber who goes by the name ‘Mr Reagan.’ It has since racked up 6.9 million views on X and has been watched by almost 200,000 people on YouTube.

Elon Musk weighs in on AI videos as governor speak out

The AI video has gained major attention since it was published and even caught the eye of technology billionaire Elon Musk who shared it on his X (formerly Twitter) profile. He didn’t explicitly mention it being doctored.

In response to the Governor of California, Gavin Newsom, who also took to X to say ‘manipulating a voice in an ‘ad’ like this one should be illegal,’ Elon hit back.
